General Policies BBQ Quebec Contest
1. Non-compliant participation
The contest organizers reserve the right to disqualify any person or to cancel one or more entries of any person participating in this contest or attempting to participate by a means contrary to these rules or likely to be unfair to other participants (e.g. use of ballots obtained from an unauthorized source, entries exceeding the permitted limit, etc.). This person may be referred to the competent judicial authorities.
2. Acceptance of the price
Any prize must be accepted as described in these rules and may not be transferred to another person, substituted for another prize or exchanged in part or in whole for cash, except as provided in the paragraph below.
10. Price Substitution
In the event that, for reasons unrelated to the winners, the contest organizers cannot award a prize (or portion of a prize) as described in these rules, they reserve the right to award a prize (or portion of a prize) of the same nature and equivalent value or, at their sole discretion, the cash value of the prize (or portion of a prize) indicated in the rules.
11. Refusal to accept a prize
The refusal of a randomly selected person to accept a prize in accordance with the terms of these rules releases the competition organizers from any obligation related to this prize towards this person.
12. Limitation of liability – use of the prize
Any selected person releases BBQ Québec, their affiliated and related companies, their advertising and promotion agencies, their employees, agents and representatives from any liability relating to any damage that they may suffer due to the acceptance or use of their prize. In order to be declared a winner and prior to obtaining their prize, any selected person agrees to sign, if required, a Declaration Form to this effect. The guest must also sign such a Declaration Form, failing which they will not be able to benefit from the prize.
13. Declaration form. Limitation of liability – operation of the competition
BBQ Québec, their affiliated and related companies, their advertising and promotional agencies, their employees, agents and representatives disclaim any liability for the malfunction of any computer component, software or communication line, for any transmission that is faulty, incomplete, incomprehensible or deleted by any computer or network, including telephone, and which may limit the possibility of or prevent any person from participating in the contest. BBQ Québec, their affiliated and related companies, their advertising and promotional agencies, their employees, agents and representatives also disclaim any liability for any damage or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any Internet page, software or form and by the transmission of any information for participation in the contest.
14. Modification
The contest organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this contest in whole or in part in the event of an event, error or human intervention that could corrupt or affect the administration, security, impartiality or conduct of the contest as provided for in these rules, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, if required. In all cases, the contest organizers, their affiliated and related companies, their advertising and promotional agencies, suppliers of products or services related to this contest and their employees, agents and representatives, may not be required to award more prizes than those indicated in these rules or to award prizes other than in accordance with these rules.
15. Inability to act – labor dispute
BBQ Québec, their affiliated and related companies, their advertising and promotional agencies, their employees, agents and representatives will not assume any liability of any nature whatsoever in any case where their inability to act results from a fact or situation beyond their control or from a strike, lockout or any other labour dispute in their establishment or in the establishments of the organizations or companies whose services are used for the holding of this contest.
16. Limitation of liability – participation
By participating or attempting to participate in this Contest, any person releases the Contest Organizers, their affiliated and related companies, their advertising and/or promotion agencies, their employees, agents and representatives from any liability for any damages that he or she may suffer as a result of his or her participation or attempted participation in the Contest.
17. Authorization
By participating in this competition, any winning person authorizes the competition organizers, their partners and representatives to use, if required, his/her first and last name, photograph, image, statement relating to the prize, place of residence and/or voice without any form of remuneration, at their discretion and without limit as to the period of use, in any media and on a worldwide scale, for advertising purposes or for any other purpose deemed relevant.
18. Communication with participants
No communication or correspondence will be entered into with participants in connection with this competition except with those selected for a prize.
19. Decisions of the competition organizers
Any decision of the contest organizers or their representatives relating to this contest is final and without appeal, subject to any decision of the Régie des alcools, des courses et des jeux du Québec in relation to any matter falling within its jurisdiction.
20. Dispute
A dispute regarding the organization or conduct of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. A dispute regarding the awarding of a prize may be submitted to the Régie solely for the purpose of intervention to attempt to resolve it.
21. Precedence
If any article of these regulations should be declared or deemed illegal, unenforceable or void by a competent authority, then this article will be considered null and void, but all other articles will not be affected and will find application to the limits permitted and authorized by law.
22. Copy of the regulations
The competition rules are available upon request from BBQ Québec.
23. Language
In the event of any discrepancy between the French and English versions of these regulations, the French version shall prevail.
